Healthcare Gifting FAQs

Do the industry gift bans apply to us?

Almost certainly not. The AdvaMed and PhRMA codes restrict device and pharmaceutical companies gifting physicians — they name gift baskets specifically. A hospital or practice buying gifts for its own employees is not covered by either code. That is employee recognition, and it sits outside the fraud-and-abuse rules entirely.

Can you deliver to a nursing unit?

We deliver to one named administrative contact rather than to a floor, which is both simpler and safer. OSHA prohibits food and drink in work areas where there is a reasonable likelihood of occupational exposure, so an open basket cannot sit at a nursing station. Individually wrapped items let staff carry something back to a break room.

Do you need to be a credentialed vendor?

Not for a gift delivery. Vendor credentialing through platforms like symplr or GHX is triggered by entering clinical space. Because we deliver to a single administrative point and do not enter patient care areas, the credentialing process generally does not apply. If your system requires it anyway, tell us and we will work through it.

How do you handle night and weekend shifts?

We build for total headcount, not for whoever is on at noon. Night, weekend and float staff get the identical gift, and we can schedule the drop to a shift-change window so it is not gone before third shift arrives.

Are these taxable to our employees like gift cards are?

Gift cards are cash equivalents, and the IRS is explicit that they are never excludable as a de minimis fringe benefit, no matter how small — so they become taxable wages your payroll team has to process. A physical gift of low fair market value is treated differently. We are not tax advisors and your finance office should confirm it, but this is the most common reason hospitals move off gift cards.

What about gifts to physicians on our medical staff?

That is a different question from staff appreciation, and there is a specific allowance for it. The Stark Law nonmonetary compensation exception permits a set dollar amount per physician per calendar year in items and services — not cash and not gift cards. The figure is adjusted annually. We can itemize per-recipient value on your invoice so your compliance team can track it against the cap.

Can everyone get the same thing?

Yes, and we recommend it. Uniform contents across the whole order avoids the fairness problem an assorted mix creates on a unit. We also label allergens on every item, keep everything shelf stable, and never include alcohol.

Can you add our system logo?

Yes. Logo placement on the message card is free, and we offer custom-printed ribbon, logoed box wrap, custom sticker labeling, branded bows, and in-house laser engraving on keepsakes, drinkware and boards.

Can you ship to multiple campuses?

Yes. We regularly ship to hundreds of individual addresses with tracking on every package and free shipping to the US mainland. Multi-campus systems can have each site scheduled separately.

Can you process tax-exempt orders and provide a W-9?

Yes to both, with the correct legal documentation on file. We can provide a W-9 for your vendor and accounting setup, and we accept company checks alongside major credit cards.
