Three Recipients, Three Different Rules

Most gift vendors treat every name on your list the same way. Texas does not. Worth getting straight before you build the list.

  • Insureds and prospective insureds. This is where anti-rebating law lives. Chapter 1806 of the Texas Insurance Code restricts giving valuable consideration not specified in the policy as an inducement to buy, and permits a promotional advertising item, educational item or traditional courtesy commonly extended to consumers valued at $25 or less — Sec. 1806.1041 for casualty, Sec. 1806.1541 for fire and allied lines, Sec. 1806.059 for auto.
  • Other producers who refer you business. A licensed agent is not your insured. Referral and compensation rules govern here instead, so the consumer inducement threshold is not automatically your number.
  • Your own agency staff. Ordinary employee recognition. No rebating question at all, and no reason to cap it at a policyholder number.

Insurance Gifting FAQs

We have to stay under a per-gift value for policyholders. Can you build to it?

Yes, and it is the most common way we are asked to work in this sector. You give us the ceiling, we build the gift to land under it, and the invoice states the per-gift value and the recipient count so your file has a number in writing rather than an assurance.

What is the Texas rule on gifts to insureds?

Texas anti-rebating law restricts giving an insured or prospective insured valuable consideration not specified in the policy as an inducement to buy insurance. Chapter 1806 of the Texas Insurance Code carves out an exception for a promotional advertising item, educational item or traditional courtesy commonly extended to consumers valued at $25 or less — see Sec. 1806.1041 (casualty), Sec. 1806.1541 (fire and allied lines) and Sec. 1806.059 (auto), all added by S.B. 840 in 2013. We are gift builders, not compliance counsel, so confirm the current rule and how it applies to your lines with your own compliance officer before you set your number.

Is a referral gift to another agent treated the same way?

It sits differently. A licensed producer who sends you business is not your insured, so the consumer inducement threshold in Chapter 1806 is not automatically the governing number — referral and compensation rules apply instead. Plenty of agencies still choose to hold referral gifts to the same ceiling for simplicity. That is a call for your compliance officer, not for us; tell us the number you land on and we build to it.

What about gifts to our own agency staff?

That is ordinary employee recognition and there is no rebating question in it at all. Producer awards, service anniversaries, a thank-you to the CSRs who worked a storm week — no reason to cap those at a policyholder number. Most agencies we work with run a higher budget here and are surprised they were holding back.

Can each gift be wrapped individually for handing out in the office?

Yes. Each one is wrapped and labeled on its own before it goes in the carton, so a single delivery to the branch can be handed out one at a time without anybody repackaging anything. Tell us if you want names on the labels and send the list.

Can you ship to individual addresses instead of the office?

Yes. Send the list and we pack, label and ship each one separately with tracking. For renewal and claims-appreciation gifting that usually beats sending a carton to the office and asking a producer to drive them around.

Will the invoice show the value of each individual gift?

Yes. We itemise per-gift value and recipient count rather than handing you one lump sum, because in this business somebody usually has to file it. Ask and we will break out customization and shipping as separate lines too.

Do you have a minimum order?

No. Four renewals in a slow month is a real order and gets built the same way as four hundred. This is a one-man shop in Weatherford, so you are talking to the person assembling the gift either way.

Can you add our agency logo?

Yes. Logo on the message card is free, plus custom-printed ribbon, logoed box wrap, sticker labeling and in-house laser engraving on boards, drinkware and keepsakes. Engraving and printing are done here, which is why a name and a year is a line item rather than a lead time.

Can you process tax-exempt orders, provide a W-9, and how fast is turnaround?

Yes to both, with the correct documentation on file — we can provide a W-9 for vendor onboarding and accept agency checks alongside major credit cards. Most orders of thirty or fewer finish within a day or two; larger runs get a scheduled completion date up front.
